These Official Rules apply for the Adore Me Instagram Birthday Giveaway ("Sweepstakes") sponsored by ADORE ME ("Sponsor"). The Sweepstakes will start at 12:00:00 AM Eastern Daylight Time ("EDT") on August 1, 2023 and will end at 11:59:59 PM EDT on August 6, 2023. By entering this Sweepstakes, you agree to the Terms in these Official Rules.

SWEEPSTAKES ENTRANTS AND PRIZE RECIPIENT MUST BE BOTH (A) LEGAL RESIDENTS OF ONE (1) OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA, AND (B) AGED 18 YEARS OR OLDER AT THE TIME OF ENTRY TO BE ELIGIBLE. VOID OUTSIDE THE UNITED STATES AND DISTRICT OF COLUMBIA, AND WHERE PROHIBITED BY LAW. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. 1. HOW TO ENTER: Complete the following steps to enter the Sweepstakes: (i) follow @adoreme on Instagram; (ii) “Like” Adore Me’s post announcing the Sweepstakes; (iii) comment your favorite cupcake flavor in the comments of Adore Me’s post announcing the sweepstakes; and (iv) tag someone you love celebrating with in the comments of AdoreMe’s post announcing the sweepstakes. Entrants will be contacted via DM on Instagram (depending on method of entry).  Use of automated devices is not valid for entry. Limit one entry per user on Instagram.  Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected entries that are processed late or incorrectly or are lost due to computer or electronic malfunction, Instagram platform changes or malfunction, or other error. Incomplete, unreadable, inaccurate, unintelligible or late entries which otherwise do not comply with these Official Rules will be disqualified. Your entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to administer this Sweepstakes and for other uses as permitted by applicable law.  Entries are the property of the Sponsor and will not be acknowledged or returned.

 
2. WINNER SELECTION/RANDOM DRAWING: Six (6) potential Grand Prize Winners will be selected in a random drawing from among all eligible entries received on Instagram. The random drawings will be conducted on or about August 7, 2023 by ADORE ME whose decisions are final and binding in all respects pertaining to this Sweepstakes. Odds of winning depend on the number of eligible entries received.

3. GRAND PRIZES: Each Grand Prize Winner (hereinafter, “Winner”) will be selected at random and awarded an Adore Me Alyshia Cupcake bra and panty set and an AdoreMe.com Gift Card worth up to $100. If any Winner becomes disabled or cannot otherwise fully enjoy the Sweepstakes prize due to illness, Sponsor shall have the option at its sole discretion of: (1) being relieved of liability for fulfillment of the prize award or any part thereof; (2) extending the period during which such prize may be awarded for a period equal to the duration of selected Winner's disability or illness. Selected Winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and selected Winner at selected Winner's expense.

 
4. CLAIMING PRIZE/RELEASE: Eligibility, age and claims made by each potential Winner is subject to verification. Each potential Winner will be notified by DM on or about August 7, 2023, and, provided Winner provides required information, sent via U.S. Mail and/or e-mail an affidavit of eligibility and a liability and publicity release (unless prohibited by law), which each potential Winner must sign and return to Sponsor within ten (10) business days of notification. If a Winner’s notification or prize is returned as undeliverable, or a Winner does not provide an email or mailing address, selected potential Winner is ineligible, or selected potential Winner declines the prize, their Grand Prize will be awarded to an alternate potential Winner in a random drawing from among all remaining eligible entries. Sponsor is not responsible for fraudulent e-mails made to entrants not by the Sponsor. Each Winner must supply Sponsor with his/her social security number for tax purposes. Each Grand Prize will be awarded provided each is properly claimed.

5. INTERNET: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor or Instagram which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. The Sponsor does not assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Neither the Sponsor nor any Released Entity is responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. LIABILITY & RELEASE: By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or entrants' receipt, acceptance, use and/or enjoyment of any prize. In the event the Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to virus, fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a "Force Majeure" event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elect to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event.

USE OF INFORMATION: The information that you provide in connection with the Sweepstakes may be used for Sponsor’s internal purposes and to send you information about Sponsor’s products and special promotions but will not be provided to other third parties, except as necessary for the administration of the Sweepstakes, as required by law or legal process, or in accordance with Sponsor’s privacy policies. Entry constitutes permission to post name of each Winner on Sponsor’s Website and on Social Media, and to use each Winner's name, hometown and/or likeness for purposes of advertising and promotion without notice and without further compensation unless prohibited by law. 10: The terms of this Sweepstakes are governed and interpreted pursuant to the laws of the State of New York, notwithstanding any principles of conflicts of law.  Any disputes in connection with these terms that, results in court action, except for claims that are to be handled by a small claims court, shall be resolved exclusively by a state or federal court located in New York County, New York, and you specifically consent to the personal jurisdiction of such courts and waive any objection to the convenience of this forum.

2. WINNER SELECTION/RANDOM DRAWING: Five (5) potential Grand Prize Winners will be selected in a random drawing from among all eligible entries received on Instagram. The random drawings will be conducted on or about February 2, 2023 by ADORE ME whose decisions are final and binding in all respects pertaining to this Sweepstakes. Odds of winning depend on the number of eligible entries received.

3. GRAND PRIZES: Each Grand Prize Winner (hereinafter, “Winner”) will be selected at random and awarded a $500 AdoreMe.com Gift Card worth up to $500. If any Winner becomes disabled or cannot otherwise fully enjoy the Sweepstakes prize due to illness, Sponsor shall have the option at its sole discretion of: (1) being relieved of liability for fulfillment of the prize award or any part thereof; (2) extending the period during which such prize may be awarded for a period equal to the duration of selected Winner's disability or illness. Selected Winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and selected Winner at selected Winner's expense.

 
4. CLAIMING PRIZE/RELEASE: Eligibility, age and claims made by each potential Winner is subject to verification. Each potential Winner will be notified by DM on or about February 2, 2023, and, provided Winner provides required information, sent via U.S. Mail and/or e-mail an affidavit of eligibility and a liability and publicity release (unless prohibited by law), which each potential Winner must sign and return to Sponsor within ten (10) business days of notification. If a Winner’s notification or prize is returned as undeliverable, or a Winner does not provide an email or mailing address, selected potential Winner is ineligible, or selected potential Winner declines the prize, their Grand Prize will be awarded to an alternate potential Winner in a random drawing from among all remaining eligible entries.
